Isle of Wight NHS Trust works in partnership with Portsmouth Hospitals University NHS Trust and both trusts are led by a single team of executives supported by a local Trust Leadership Team. As part of this alignment, from Tuesday 1 July 2025 the AMS domain will change to www.iowandphu-nhs.ams-sar.com
Both trusts have seen a sudden rise in Subject Access Requests, causing potential delays. Requests may not be completed within the statutory timeframe. As separate data controllers, both trusts have a legal requirement to support information requests for various legal statutory and regulatory requirements.
The trust’s Information Governance Department will manage this portal to ensure that requests are responded to and actioned as appropriate.

Subject Access Requests (SAR) – Data Protection Act 2018
Article 15 of the UK General Data Protection Regulation (UK GDPR) gives individuals, and/or their authorised representatives, the right to access copies of the information that an organisation holds on them – with some exemptions. These requests are known as Subject Access Requests (SARs). There is no charge for SARs; except in certain circumstances - such as if the request is deemed to be excessive or ‘manifestly unfounded’.
Access to Deceased Records - Access to Health Records Act 1990 (AHR)
For requesting the records of a deceased patient, only the executor, administrator or any person who may have a claim arising out of the patient's death - with proof of such, have an absolute right to the records. A grant of probate, letters of administration or a copy of the current Will are accepted as proof. Other persons may apply either with written permission from the executor or by giving their reason for making a claim to access the records.

Community and Mental Health Records for Isle of Wight patients: From 1 May 2024, Community and Mental Health & Learning Disabilities services that were previously provided by the Isle of Wight NHS Trust have transferred to Hampshire and Isle of Wight NHS Foundation Trust. Consequently, Hampshire and Isle of Wight NHS Foundation Trust are now the data controller for any new or ongoing cases for these services.
